Tyrants Win!

        In case you missed it, the Constitutional Protections from tyrannical government were just over-ridden for residents of North Richland Hills, Texas.  Judge Terry Means dismissed the wrongful death lawsuit that had been filed by Barbara Davis over the killing of her son by NRH Police.  The facts in the case were apparently never reviewed.

        Local News Only published the following:

                "The Judge’s Opinion stated that cities are not liable for actions of employees which cause constitutional injuries to others, unless such injuries result from a policy which is the moving force behind the constitutional violation. The Plaintiffs failed to identify any unconstitutional policy that caused the death of Troy Davis. The Plaintiffs also failed to establish that there were any inadequate policies which caused a constitutional violation, and failed to present any evidence of a pattern of a use of excessive force."

     The decision came down on March 13th.  This means that a no knock warrant issued on fallacious grounds is O.K. in NRH.  Such policies endorsed by Mayor Trevino and City Manager Cunningham apparently do not violate our Constitutional rights to be secure in our homes.  The tampering with the crime scene is also within the policies and rights that we no longer enjoy.  The withholding of evidence by the City Attorney is also apparently endorsed by this ruling.   Perhaps most importantly, the ruling by Judge Means would allow city employees (Police) to injure or kill citizens with impunity if such injuries or death was not the result of City "policies".  Unfortunately, Mrs. Davis does not have the unlimited money bucket of the city. 

        Mayor Trevino was quoted in the Local News Only article with the following:
“We have always believed that our employees and supervisors acted appropriately in their handling of the Davis situation and the court has agreed,” said Mayor Oscar Trevino. “This is very positive news for the City of North Richland Hills. The legal process has worked and we look forward to finally putting this matter behind us.”

        Yes, the legal process worked for the city using our endless tax dollars in the hundreds of thousands of dollars.  It proved that the power to tax overrides any citizen rights.  It proves that the local government can kill one of our citizens without the threat of retribution or correction.  It also proves that the leadership of the city under Trevino and Cunningham has no respect for citizen rights.

        In North Richland Hills there is no respect for the Constitution or Constitutional Rights!

        Perhaps the current aristocracy governing our city should adopt the horrific flag shown above.   They truly got away with murder!
